Changes in the Law in Favor of the Employees

There have been three important changes to the law that favor employees.

The first is that the statute of limitations has been increased from one year to three years.

The second is that a single incident is now enough to create a hostile work environment. Formerly, California followed the U.S. Supreme Court’s definition of hostile work environment as requiring more than a single incident, which is now limited to Title VII sexual harassment claims. The broader definition was passed by the state legislature and applies to sexual harassment under state law.

The third is that employees will now have an easier path to trial. This is the result of the California legislature amending the law in favor of the employees in terms of what the employee must prove to get to trial.
