Issues with FMLA? Obtain the Powers of a Los Angeles Employment Lawyer!
Sometimes your life outside of work takes priority over anything else. When major life events occur, you may need to step away from work for a period to take care of them. At Alan Burton Newman, PLC, our Los Angeles employment law attorney understands that you have other obligations and responsibilities and wants you to know your rights under California employment law.
What is the Family Medical Leave Act (FMLA)?
The Family Medical Leave Act (FMLA) provides employees with the right to take time off work for certain family-related circumstances without sacrificing health insurance coverage or other benefits.
Under the guidelines of FMLA, you are eligible to take leave for the following reasons:
- To care for a newborn child
- To care for a newly adopted or fostered child
- To care for a child, spouse, or parent with a serious medical condition
- To care for your own serious medical condition
If you were denied benefits or your right to take maternity leave or an absence for other family-related reasons, it is possible that your rights are being violated.
Differences between FMLA and CFRA
The Family and Medical Leave Act (FMLA) is a federal statute, whereas the California Family Rights Act (CFRA) is a California statue. These statues are identical except for two important areas. The FMLA requires that the employee's doctor disclose the medical diagnosis of the employee. Under CFRA the medical diagnosis is not going to be disclosed by the doctor, providing privacy for California patient.
The second advantage of CFRA is that it can be combined with Pregnancy Leave of Absence to provide employees with up to seven months of leave for pregnancy. Employers typically designate the employees' rights under FMLA; notwithstanding the employer's designation, employees retain their rights under CFRA. It is important for an attorney to represent you to make sure you get those rights.
